("DraftKings", "we", "us", or "our"). By registering an account, depositing funds, or submitting any real-money wager or entry, you enter into a legally binding contract.
1. Age Eligibility & Statutory Qualifications
Participation in real-money sports wagering and digital casino gaming through DraftKings is strictly restricted by law:
- Age Restriction: You must be at least twenty-one (21) years of age to establish a sports betting or online casino account. In specific states and categories (such as non-gambling daily fantasy sports), participants must be at least eighteen (18) or nineteen (19) years of age as dictated by state statutes.
- Prohibited Persons: Any athlete, coach, official, team employee, referee, league executive, or casino vendor employee subject to league or state wagering prohibitions is strictly barred from wagering on relevant athletic contests.
- Self-Excluded Persons: Individuals listed on any mandatory state gaming exclusion list or voluntary self-exclusion registry are strictly prohibited from opening accounts or placing bets.
2. Account Registration & Mandatory KYC Verification
Each patron is permitted exactly one (1) active DraftKings account. Creating duplicate, fraudulent, or alias accounts is a severe breach of this Agreement.
Federal Know-Your-Customer (KYC) and Anti-Money Laundering (AML) mandates require DraftKings to authenticate your legal identity prior to releasing withdrawal funds or permitting high-volume wagers. You agree to submit true, accurate, and current documentation—including government photo identification, proof of address, and Social Security confirmation—upon request. Providing fabricated credentials results in immediate account forfeiture and notification to regulatory authorities.
3. Geolocation & Interstate Wagering Prohibitions
In strict compliance with the Unlawful Internet Gambling Enforcement Act (UIGEA) and individual state gaming acts, real-money wagering is permitted solely when you are physically located within the physical borders of a state that has explicitly authorized DraftKings operations.
DraftKings utilizes automated geofencing software to verify your physical coordinates before each wager slip is registered. The use of proxy networks, virtual private networks (VPNs), location masking tools, or remote desktop software to disguise your physical whereabouts is strictly prohibited and constitutes grounds for immediate account suspension, wager voidance, and confiscation of unlawful winnings.
4. Single-Wallet Architecture & Banking Protocols
DraftKings provides an Omnichannel Single Wallet enabling consolidated access to sports betting, casino games, and fantasy pools. All transactions are governed by rigorous security protocols:
- Source of Funds: All deposits must originate from personal financial accounts registered under the exact legal name matching the patron's DraftKings profile. Corporate cards, third-party accounts, and anonymous payment instruments are strictly disallowed.
- Wagering Requirement on Deposits: In accordance with federal AML policies, deposited funds must undergo standard gaming playthrough before they become eligible for withdrawal. Depositing funds purely for transfer or liquidity purposes is prohibited.
- Withdrawal Approvals: Approved payouts are returned through the original deposit method whenever technically feasible (e.g., PayPal, direct ACH banking, or VIP Preferred e-check). Processing typically concludes within 12 to 24 hours.
5. Wagering Rules, In-Play Micro-Betting & Line Palp Errors

- Wager Confirmation: A wager is deemed officially accepted once a unique Ticket ID is generated and recorded on our server. Bettors cannot manually cancel or alter wagers once submitted.
- Obvious Errors ("Palpable Errors"): In rare instances where an obvious technological, typographical, or human data error leads to odds or lines offered that radically deviate from true market rates, DraftKings reserves the right to void the erroneous wager or settle it at the corrected market price in adherence to state gaming guidelines.
- Micro-Betting Mechanics: Live in-play propositions depend upon official league statistics. If an athletic event is abandoned, postponed, or interrupted, wagers are settled according to official sport-specific House Rules.
- Casino RNG Certified Play: Digital slots and virtual table games employ certified Random Number Generators (RNG) tested by independent testing laboratories (such as GLI and BMM Testlabs). Malfunctions void all pays and plays.
6. Dynasty Rewards & Promotional Terms
Promotional bonuses, odds boosts, deposit matches, and Dynasty Rewards Crowns are extended subject to specific promotion terms. Bonus bets cannot be cashed out directly; only net winnings resulting from bonus bets are credited as withdrawable cash. DraftKings reserves the right to withhold promotional privileges from patrons engaging in bonus manipulation or arbitrage strategies across competing books.
7. Prohibited Conduct & Account Termination
Patrons must not engage in any illicit, disruptive, or fraudulent activity, including but not limited to:
- Employing artificial intelligence bots, scraping scripts, or automated wagering programs.
- Engaging in syndicate betting, syndicate pool sharing, or collusion with other account holders.
- Exploiting system bugs, game glitches, or broadcast latency loopholes.
- Attempting to charge back legitimate card deposits or initiating fraudulent payment claims.
DraftKings reserves the right to suspend or permanently close accounts, void pending bets, and retain illicit balances for restitution in the event of validated breaches.
8. Limitation of Liability & Disclaimers
DraftKings operates its software infrastructure on an "as is" and "as available" basis. While we strive to maintain uninterrupted 24/7 service, DraftKings shall not be held liable for losses or lost wagering opportunities resulting from internet connectivity failures, mobile hardware issues, telecommunication interruptions, or unscheduled maintenance outages.
9. Dispute Resolution & State Regulatory Recourse
If a dispute arises regarding a settlement, bet slip calculation, or account decision, patrons must first submit an inquiry through DraftKings Customer Support. If the issue remains unresolved, patrons hold the legal right to submit a formal patron dispute to the relevant state gaming commission (e.g., NJ DGE, PGCB, MGCB), whose determination shall be definitive under state administrative gaming law.
